If an individual does not have the requisite mental capacity to execute an LPA, it is possible to make an application to the Court to have someone appointed as Deputy.
What role does the Deputy perform?
A Deputy is appointed by the Court to either deal with someone's financial affairs, or make decisions in relation to their personal welfare. There can be separate Duputies for each.
A Deputy has a duty to act in the patient's best interest and matters may need to be referred to the Court from time to time. Annual accounts have to be prepared by the Deputy and submitted to the Court.
